These Terms of Use ("Terms") govern your access to and use of AI for Your Day, located at aiforyourday.com ("the site," "we," "us"), and our newsletter (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.

1. Eligibility

The Services are intended for users 13 years of age or older (16 in some jurisdictions). By using the Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Use of the Services

2.1 Permitted use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use, subject to these Terms.

2.2 Prohibited use

• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Engage in any activity that violates applicable laws or regulations.
• Transmit viruses, malware, or other harmful code via the Services.
• Bypass any access restrictions, paywalls, or rate limits.

3. Content

3.1 Our content

All content on the site — including articles, layouts, original images, illustrations, graphics, design elements, and other materials (collectively, "Content") — is owned by AI for Your Day or licensed to us, and is protected by copyright, trademark, and other intellectual property laws.

3.2 Limited reuse

You may quote brief excerpts (up to approximately 100 words) for non-commercial purposes with clear attribution and a link back to the original article. For longer reuse, republication, or commercial use, contact us at help@aiforyourday.com.

3.3 Trademarks

"AI for Your Day" and the site's logo are unregistered trademarks of AI for Your Day. Other names, logos, and trademarks mentioned on the site are the property of their respective owners.

3.4 DMCA / copyright complaints

If you believe content on the Services infringes your copyright, send a written notice to help@aiforyourday.com with: (a) identification of the copyrighted work; (b) identification of the allegedly infringing content; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; and (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.

4. Newsletter

If you subscribe to our newsletter:

• You consent to receive emails from us at the address you provided.
• You can unsubscribe at any time using the link in any newsletter email.
• Unsubscribing applies only to marketing communications, not to operational emails (e.g., responses to your inquiries).
• We use third-party services (currently Beehiiv) to send the newsletter. See our Privacy Policy for details.

The Services link to and reference third-party tools and websites. We have no control over those third parties and are not responsible for their content, privacy practices, terms, or any harm or loss caused by them.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• AI FOR YOUR DAY AND ITS OPERATORS, AGENTS, AND AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR ANY DECISIONS MADE BASED ON CONTENT FROM THE SERVICES.
• OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.
• SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY. IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

8. Indemnification

You agree to indemnify, defend, and hold harmless AI for Your Day and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit to us.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

10. Governing law and dispute resolution

These Terms are governed by the laws of the United States (and the State of New York, without regard to its conflict-of-laws principles), except that consumer protection laws of your jurisdiction of residence may also apply.

Any dispute arising out of or relating to these Terms or the Services will be resolved first through good-faith informal discussions. If unresolved after 30 days, the dispute will be settled by binding individual arbitration administered by a recognized arbitration body, except where prohibited by law. You agree to waive any right to participate in a class action or class arbitration.

If arbitration is not enforceable, disputes will be resolved in the state or federal courts located in New York, and you consent to personal jurisdiction there.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Material changes will be communicated via the newsletter or a notice on the site. Continued use of the Services after changes constitutes acceptance of the updated Terms.

12. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be interpreted to most closely accomplish the parties' original intent within the limits of applicable law.

13. Entire agreement

These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and AI for Your Day regarding the Services. They supersede any prior agreements or understandings.
